Terms of Service

• You must be 21 years of age or older and a legal resident of the United States.
• You must provide accurate registration information and keep it current.
• You may not use the Service if a court order, our prior decision, or applicable law prohibits you from doing so.

The Doyen is a community and editorial product about cigars and their pairings. We do not sell tobacco. We do not facilitate the sale of tobacco. Nothing in the Service is medical or health advice. Smoking is a personal choice with documented risks; smoke responsibly and only when and where it is legal to do so.

You are responsible for your account, including for keeping your password secret and for any activity under your account. Tell us right away at support@creadio.com if you suspect unauthorized access.

You may close your account at any time from My Account in the app or by visiting thedoyen.club/delete-account.

You keep ownership of the content you post. Your tasting notes, photos, bio, and avatar (“Member Content”). By posting, you grant The Doyen a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service and to feature it within the Service (for example, on your public profile page or in promotional context with attribution). You can revoke this license by deleting the content or your account.

You represent that you have the rights to everything you post and that it does not infringe anyone else’s rights or violate the law.

We do not allow content or behavior that:

• Harasses, threatens, defames, or sexually exploits another person.
• Is hateful, discriminatory, or promotes violence.
• Markets, advertises, or facilitates the sale of tobacco, alcohol, cannabis, firearms, drugs, or any other regulated product.
• Impersonates another person or misrepresents your affiliation.
• Contains spam, scams, or commercial solicitations not authorized by us in writing.
• Infringes intellectual property or privacy rights.
• Tries to circumvent our security, rate limits, or moderation systems.

We may remove content, suspend, or terminate any account that violates these rules, at our discretion, without notice. You can report violations by long-pressing or selecting the “Report” action in the app, or by emailing support@creadio.com. You may also block another member at any time.

The free tier is available at no charge. Paid memberships are billed annually in advance through Stripe (or, where the law requires, through the platform store you bought from). Paid membership renews automatically until you cancel.

Cancellations take effect at the end of the current billing period. Except where required by law, paid amounts are non-refundable.

We may change prices, plans, or perks with advance notice. Material price changes will be sent to you by email at least 30 days in advance and will only apply at your next renewal.

The Service, including the brand, design, software, editorial content, and curator posts, is owned by The Doyen and protected by law. You may not copy, redistribute, scrape, or build a competing product on top of it without our written permission.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or our community rules, or if we reasonably believe doing so is necessary to protect The Doyen, our members, or the public. Sections of these Terms that by their nature should survive termination (ownership, disclaimers, limits, dispute resolution) will survive.

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, The Doyen will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose or (b) $100.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws rules. You and The Doyen agree to resolve any dispute in the state or federal courts located in Franklin County, Ohio, and submit to the personal jurisdiction of those courts. Either party may seek injunctive relief in any court to protect intellectual property.

We may update these Terms from time to time. We will post the new version here and update the effective date. For material changes, we will notify you by email or in-app notice before they take effect.
